Can you put someone elses last name on a B.C if you dont have a paternity test done n hve no proof hes the dad

someone i used to be friends with had a baby and she is trying to blame my friend of being the father. she now lives in N.C and a paternity test has not been done. she had the baby last friday and is saying that she put his(my friends)last name on the babys birth certificate. again we have not seen the B.C to really know, and what im wondering is can you really put someone elses last name on the B.C if a paty test has not been done and there is no proof he is the father? we are waiting for a copy of the hospital papers and B.C now. but i wanted to know if you can really do that. i have tried looking it up but i cant find it. mind you she lives in N.C so i dont know if that makes a difference. please let me know as soon as possible. thanks.

He has to consent and sign the ceritificate before it is legal.
Reply:The laws vary state by state. Also, you must consider whether it was ONLY the B.C. or a document called the "affadavit of paternity" or "paternity acknowledgment form" as well. Those two forms can be even harder to rescind (take back) a signature on.

Reply:You can put ANY last name you want. You could name your child John Zipadeedodah if you wanted to. I would beleive her, she has no reason to live and doesnt need anyones permission to use his last name for the baby, but proubably only would if she really thought baby was his anyways.





Sounds to me like you were hoping she couldnt do that and that you proubably hope it isnt his baby,

She can use the name. Not just in NC but anywhere in the USA





I only rule is you can use symbols (!@#$%) or numbers








Now, about his NAME being on the certf. that need him their with I.D and to "conset paternity" but signing it.
Reply:You can name the baby whatever you please, last name included. Just because you use someones last name doesn't make them the father, and the law recognizes this - the only way to list a father on the birth certificate is if the woman is married (then her husband is automatically considered the father) or if the man who thinks he is or claims to be the father signs an affidavit of parentage and willingly signs the birth certificate. It really makes no difference if this woman gave her baby your friends last name - that's her business and doesn't affect any man who happens to also have that same last name.
Reply:She can put whatever last name she wants for the baby on the B.C HOWEVER she CANNOT put his name on the B.C without his consent. There are a bunch of papers that he would have had to sign when the baby was born that would state that he takes responsibility and he agrees that it's his baby. So yes she can give the baby his last name but she can't just like go and take him for child support .... if he says it's not his baby then there will have to be a paternity test and stuff like that,.

Reply:sorry, but as sad as it is, you can put ANY name on a BC in ANY state...the only way to have it reversed is to get a DNA and prove you are not the father...(then if i was your friend after i proved i wasnt the father id slam her a** with a slander suit and sue her for defamation of character!)
